Waiting periods run from the end of the sentence: three years for infractions and class C misdemeanors, four for class B, five for class A, seven for eligible felonies, and ten for misdemeanor DUI. Which Davis County court holds the record.

Layton cases sit in the Layton Department. Kaysville, Farmington, and other cities without a justice court sit in the Davis County Justice Court at the Farmington complex. Clearfield, Bountiful, and Syracuse have their own courts. Felonies are in the Farmington district court. Getting the court wrong on a petition costs the filing fee and the certificate.

Utah’s automatic expungement law clears some minor misdemeanors without a petition, but never felonies, DUI, or most pleas in abeyance, and the automatic system was paused through 2025 before resuming in January 2026. If you are waiting on it, the record is probably still public. A petition is usually faster.

The 402 reduction as a path to eligibility.

A felony that is not eligible today may become eligible after a reduction in degree under Utah Code § 76-3-402, filed in the Farmington district court where the conviction was entered. We sequence the two motions so the reduction opens the door rather than resetting the clock.
